These Terms of Service (“Terms”) govern your access to and use of concentratedatmosphere.com and any products or services offered by Concentrated Atmosphere (“Concentrated Atmosphere,” “we,” “us,” or “our”).

By accessing our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree, please do not use the website or services.

1. Use of Our Website

You may use this website only for lawful purposes.

You may not:

Use the website in violation of applicable law;
Infringe or attempt to infringe the intellectual-property or other rights of another person;
Interfere with the security, functionality, or operation of the website;
Attempt to obtain unauthorized access to accounts, systems, or data;
Introduce malicious code, automated scraping systems, or other technologies intended to disrupt or misuse the website; or
Use our artwork, photographs, designs, or other content for unauthorized commercial purposes.

We may restrict or terminate access to the website when reasonably necessary to protect Concentrated Atmosphere, our customers, or others.

2. Products and Artwork

Concentrated Atmosphere sells artwork and art-related products, which may include prints, signed prints, numbered editions, limited-edition products, stickers, merchandise, custom products, and other creative goods.

We make reasonable efforts to describe and display our products accurately. However, colors and appearance may vary slightly because of differences in screens, lighting, printing processes, materials, and production methods.

Minor variations that are normal to printing, handmade production, signing, numbering, or finishing are not considered defects.

Product dimensions are approximate unless expressly stated otherwise.

3. Limited Editions, Signed and Numbered Artwork

Some products may be identified as signed, numbered, limited edition, or otherwise limited in availability.

Edition numbers do not guarantee future monetary value, resale value, collectability, or appreciation.

Once a limited edition sells out, we are not obligated to reproduce or restock that edition.

Unless otherwise expressly stated, signed, numbered, limited-edition, customized, personalized, and final-sale items are subject to the restrictions described in our Return & Refund Policy.

4. Orders

Submitting an order does not guarantee acceptance.

All orders are subject to product availability, payment authorization, fraud screening, and our acceptance.

We reserve the right to refuse, limit, or cancel an order for legitimate reasons, including:

Product unavailability;
Pricing or listing errors;
Suspected fraud or unauthorized payment activity;
Orders placed for unauthorized resale;
Shipping restrictions; or
Other legal or operational reasons.

If we cancel an order after payment has been collected, we will issue the appropriate refund to the original payment method.

5. Pricing

Prices are displayed in U.S. dollars unless otherwise stated.

Prices, product availability, promotions, and discounts may change without notice.

If a product is mistakenly listed at an incorrect price, we may cancel the affected order and issue a refund rather than fulfill the order at the erroneous price.

Applicable taxes and shipping charges will be displayed during checkout when required.

6. Payment

Payments may be processed through Shopify or other third-party payment processors.

By providing payment information, you represent that you are authorized to use the payment method and authorize the applicable payment provider to process the transaction.

We generally do not directly store complete payment-card information.

7. One-Time Purchases

Unless a product page and checkout process clearly state otherwise before purchase, products sold by Concentrated Atmosphere are intended to be one-time purchases.

A subscription, recurring purchase, installment arrangement, preorder, or deferred-purchase arrangement will apply only when it is clearly disclosed to the customer before the order is completed.

Customers will not be intentionally enrolled in recurring billing merely by purchasing a standard artwork, print, or merchandise product.

8. Shipping and Delivery

Orders are subject to our Shipping Policy.

Processing and delivery estimates are provided in good faith but are not guarantees unless expressly stated otherwise.

Customers are responsible for providing a complete and accurate shipping address.

If we are unable to ship within a timeframe we represented, we will handle the delay, cancellation option, and any required refund in accordance with applicable law.

9. Returns, Refunds and Cancellations

Returns, refunds, exchanges, damaged items, and cancellations are governed by our Return & Refund Policy.

Certain products, particularly signed, numbered, limited-edition, customized, personalized, or final-sale products, may not be eligible for ordinary returns.

Nothing in these Terms eliminates rights that cannot legally be waived.

10. Ownership of Artwork and Copyright

Unless expressly stated otherwise, all artwork, illustrations, designs, graphics, logos, photographs, product imagery, written content, visual content, and other original material displayed or sold by Concentrated Atmosphere are owned by or licensed to Concentrated Atmosphere and are protected by applicable intellectual-property laws.

Purchasing Artwork Does Not Transfer Copyright

Purchasing an original artwork, print, signed print, numbered print, limited-edition piece, or other physical product gives the purchaser ownership of that physical item only.

Purchase does not transfer copyright, reproduction rights, licensing rights, merchandising rights, digital-use rights, commercial-use rights, or any other intellectual-property rights in the underlying artwork unless Concentrated Atmosphere expressly agrees otherwise in writing.

Without written permission, purchasers may not:

Reproduce the artwork;
Sell reproductions of the artwork;
Use the artwork on merchandise or products;
Mint or tokenize the artwork as an NFT or other digital asset;
Use the artwork in branding, advertising, or commercial materials;
Create derivative commercial products from the artwork; or
License or authorize others to use the artwork.

Nothing in this section prevents the lawful resale or display of a physical item owned by the purchaser where permitted by law.

11. Website Content

The Concentrated Atmosphere name, logos, graphics, photographs, website designs, product images, text, and other website materials may not be copied, republished, reproduced, distributed, modified, or commercially exploited without authorization except as permitted by law.

12. User Content

If you voluntarily submit a review, photograph, comment, testimonial, social-media content, or other material to Concentrated Atmosphere, you represent that you have the right to submit it.

You retain ownership of your content.

You grant Concentrated Atmosphere a nonexclusive, worldwide, royalty-free license to display, reproduce, repost, and use that content for purposes reasonably related to operating, promoting, and marketing Concentrated Atmosphere.

We may remove or decline to publish submitted content at our discretion.

13. Third-Party Services

Our website may use or link to services operated by third parties, including Shopify, payment providers, shipping carriers, social-media platforms, analytics providers, and other service providers.

Those services may have separate terms and privacy policies.

We are not responsible for the independent operation, availability, content, or practices of third-party services.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an “as is” and “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, completely secure, or free from harmful components.

Nothing in these Terms excludes warranties, consumer protections, or other rights that cannot legally be excluded.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Concentrated Atmosphere and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of our website, services, or products.

To the fullest extent permitted by law, our aggregate liability relating to a particular product or transaction will not exceed the amount actually paid to Concentrated Atmosphere for the product or transaction giving rise to the claim.

This limitation does not apply where liability cannot legally be limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Concentrated Atmosphere and its owners, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, and reasonable expenses arising from your unlawful misuse of the website, material violation of these Terms, or infringement of another person’s rights.

17. Termination

We may suspend or terminate access to the website or services where reasonably necessary because of a violation of these Terms, suspected fraud, unlawful conduct, security concerns, or misuse of our services.

Sections that by their nature should survive termination, including intellectual-property provisions and applicable liability provisions, will remain effective.

18. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.

Subject to any rights that cannot legally be waived, disputes shall be handled by a court with appropriate jurisdiction in Michigan.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

20. Changes to These Terms

We may update these Terms from time to time.

When changes are made, we will update the effective date displayed on this page. Changes apply prospectively from the date they become effective unless otherwise required by law.
